Land Use and Real Estate Litigation
Brian has represented landowners and government agencies in disputes involving nonconforming uses, special permitting, wetlands regulations, and boundary issues. Brian knows that a firm command of applicable law together with careful case preparation, often with the help of expert professionals, is the key to success in these areas.
As an assistant New York City Corporation Counsel, Brian brought multiple cases that vindicated the public interest in land use and related regulatory areas. For information about some of these cases, see OTR Media Group, Inc. v. Board of Standards and Appeals, 141 A.D.3d 417 (1st Dep’t 2016) (rejecting nonconforming use protection illegal advertising signage); City of New York v. Beam Bike Corp., 206 A.D.3d 447 (1st Dep’t 2022) (affirming trial court order enjoining bike share operator’s ongoing violations of surface transportation regulations); and Emily Saul, “Floating digital billboard company must stay out of NYC or pay $100K,” New York Post, Oct. 8, 2019. In private practice, Brian has appeared before land use regulating agencies, including planning boards and zoning boards of appeal, and in judicial appeals of agency decisions.
